TERMS AND CONDITIONS



1. UlizaHOW? is a marketing trade name of Mavuno Business System in conjunction with Newlope Contents, that (1)markets the service offered by The Giving Hands Consortium, and (2) intermediates between a Generous-Funder abroad and a Fund-Seeker in Kenya.


2. A Generous-Funder is a member of The Giving Hands Consortium, a private, US-based, voluntary, membership, umbrella organization of Generous-Funders, who are successful business people, committed to alleviate poverty in Africa by strengthening hawking and small-scale businesses.


3. A Fund-Seeker is an active hawker or small-scale business owner, based in Africa (in our case, in Kenya), who is looking for a financial help to boost their already existing hawking or small-scale business activities. Therefore, a Fund-Seeker, is not a start up hawker nor small-scale business owner.


4. A Fund-Seeker in Kenya who wishes to get connected with a Generous-Funder overseas, must formally submit their request through UlizaHOW? for validation.


5. A Fund-Seeker who receives a financial help from a Generous-Funder, automatically becomes a Fund-Recipient.


6. Someone who's looking for a financial help for other purposes such as hospital bill, school fee, church work, community project etc, is not a Fund-Seeker and cannot be served by UlizaHOW?.


7. To make a request for financial help, a Fund-seeker must reach UlizaHOW?'s homepage and click on a green button entitled "SUBMIT REQUEST." This is done by logging in directly to www.ulizahow.com or simply by google search "Ulizahow."


8. A Fund-Seeker who's requesting for a financial help, must meet the following requirements:

(1). They must have an email address. Communication between a Fund-seeker and their Generous-Funder is done strictly through email. Therefore, a Fund-Seeker must provide an accurate email address.

(2). They must have a bank account. A Generous-Funder will always fund a Fund-Seeker through a bank account. No any other money transfer channel will be used.

(3). They must purchase a stamp for every request. The stamp validates the request. It assures a Generous-Funder that the request for financial help from a Fund-Seeker they don't know is genuine. Therefore, a Generous-Funder will be convinced that a Fund-Seeker has been vetted and will be confident to reply and to keep corresponding with them.


9. A stamp costs KES 100. It's bought once when a Fund-Seeker is making and sending in their request to a selected Generous-Funder which is done within the system of UlizaHOW?. Purchase of stamp is done through Lipa Na M-Pesa Buy Goods Till Number 918477. Payment is credited to Mavuno Business System, one of the custodians of UlizaHOW?.


10. A stamp can also be borrowed by a Fund-Seeker. This allows them to connect with a selected Generous-Funder but they cannot correspond with them. To correspond with their selected Generous-Funder, a Fund-Seeker must pay for the borrowed stamp first.


11. When making their request for a financial help, a Fund-Seeker must fill in a request form which has 8 to 9 mandatory fields and one optional.


12. If a Fund-Seeker fails to validate their request with a stamp, their request shall be rejected, since the M-pesa code received after purchasing the stamp through the above Till Number is automatically the stamp receipt number. A Fund-Seeker who has borrowed a stamp, will be provided with a borrowed stamp receipt number which will be replaced automatically with a paid stamp receipt number once they pay for the stamp they borrowed.


13. A Fund-Seeker who provides a wrong or a used or a fake Mpesa code (Stamp receipt number), shall have their request rejected.


14. The process of making and sending in a request and corresponding with a Generous-Funder is completely free. The only monetary commitment from a Fund-Seeker is KES100 for the stamp at the initial stage of their request. Therefore, a Generous-Funder will NEVER ask a Fund-Seeker to pay any fee.


15. Any request submitted successfully shall automatically receive a Request Number. The latter is the prime identifier of a Fund-Seeker within the systems of both UlizaHOW? and the Generous-Funder's umbrella organization The Giving Hands Consortium.


16. Once their request is delivered, a Fund-Seeker should expect a reply from their selected Generous-Funder within 2 to 7 days; sundays and holidays included. Practically, a request validated with a paid stamp will get replied faster than a request validated with a borrowed stamp.


17. If a Fund-Seeker hasn't received any reply from their selected Generous-Funder, wihin the 7 days time frame, they should send their complaint directly to the secretariat of The Giving Hands Consortium on WhatsApp: +1 234 280 3227 or email:sec@thegivinghands.net.


18. A Fund-Seeker can make as many requests as they wish. They can still get connected to the same Generous-Funder with the same request or different requests. They can get connected to all Generous-Funders with different requests, as long as each request is validated through UlizaHOW? with a stamp.


19. Once a Fund-Seeker receives a reply to their request, they can now correspond with their Generous-Funder without any interruption.


20. Correspondence between a Fund-seeker and their Generous-Funder is guided by rules established by The Giving Hands Consortium and is done INDEPENDENTLY from UlizaHOW?. Therefore, UlizaHOW? has no authority over a Generous-Funder and cannot influence them to favour a particular Fund-Seeker. It's the responsibility of a Fund-Seeker to meet their Generous-Funder's expectations in order to get the financial help they've requested.


21. Correspondence between a Fund-Seeker and their Generous-Funder is generally done in two steps as follows:

Step one: A Fund-Seeker describes their business. The very one they specified in their request. If their business description is satisfactory, meaning it scores 50+ points plus out of 100, then a Fund-Seeker takes the next and final step.

Step two: A Fund-Seeker takes a Biz-Test which is a business quiz generated from their business description. If a Fund-Seeker passes the test, they'll automatically qualify for the financial help they requested. If a Fund-Seeker fails the test, they'll not qualify for the financial help they requested.


22. Before taking their Biz-Test, a Funder-Seeker is required first to agree with the 10 binding rules of their Biz-Test and second to proceed or to decline taking their Biz-Test. Therefore, it's a Fund-Seeker's choice to take the Biz-Test.


23. UlizaHOW? does not generate the Biz-Test. The latter is generated by the East Africa Test Providers Panel of The Giving Hands Consortium on behalf of the Generous-Funder.


24. UlizaHOW? shall not be answerable nor liable for the failure of a Fund-Seeker to get a financial help from their Generous-Funder.


25. All Generous-Funders operate independently from each other but they're all under the auspices of their umbrella organization "The Giving Hands Consortium." Therefore, a Fund-Seeker can receive financial help from different Generous-Funders on their same request.


26. Once a Fund-Seeker qualifies for a financial help from their Generous-Funder, the following happens:

(1). Their Generous-Funder will ask them for their bank details (Bank and branch, bank account number and name).

(2). Their Generous-Funder will instruct UlizaHOW? to serve them with their assistance money.

(3). UlizaHOW? will immediately contact a Fund-Seeker and then deposit the money to their bank account through M-Pesa paybill. The UlizaHOW?'s officer in charge of deposits is Mr. Marcel Musyoki.

(4). A Fund-Seeker who's now a Fund-Recipient acknowledges receipt of their financial help both to UlizaHOW? and to their Generous-Funder.


27.. The official US Dollar forex exchange currently used by a Generous-Funder to a Fund-Recipient is US$1 = KES100.


28. The financial help is not a loan but a generous fund intended to build capacity of a Fund-Recipient as they strive to boost their micro/small business activity. Therefore, a Fund-Recipient will be under no obligation to repay the money.


29. A Fund-Recipient is accountable directly to the Generous-Funder for the financial help they receive.
